As demand for digital infrastructure skyrockets, Winstead continues to serve as a key legal partner for developers building data centers that power our connected world. A prominent example is our work with ACS Infrastructure Development Inc. (a subsidiary of ACS Group), who partnered with Winstead as local counsel for their planned $2.1 billion investment in a major data center campus in northwest Fort Worth.
Successfully developing data centers hinges on navigating specific legal and regulatory hurdles, a core strength of Winstead’s Real Estate Industry Group. For ACS Infrastructure, our team, spearheaded by Shareholder Laura Hoffmann, secured economic development incentives vital for project viability and conducted zoning due diligence for the 107-acre site—essential steps for facilities with significant power and footprint requirements. As Texas Local Counsel, we ensure the project integrates seamlessly with local regulations.
Winstead understands that data center site selection and development involve unique complexities. Shareholder Rebecca Bergeron applied her expertise to manage the oil and gas matters associated with the transaction, proactively addressing issues often encountered on large Texas land tracts suitable for data centers. Winstead attorneys Daniel Box, Ginger Epstein, and Fred Tuthill are key members of the extended team, collectively providing support for this data center project.
From navigating economic development programs to complex real estate and energy considerations, Winstead provides the comprehensive counsel data center developers need. Our work with ACS Infrastructure on this Fort Worth project underscores our firm’s deep experience and ongoing commitment to facilitating the growth of digital infrastructure across Texas and beyond.
